Regulation (EU) 2025/40 on packaging and packaging waste (PPWR) applies from 12 August 2026. Article 19 sets duties for distributors who make packaging available on the market. This guide quotes confirmed PPWR text for distributor checks, document hand-over and own-brand scenarios. Sources checked 2026-10-01. Product Registry helps you record roles and evidence; it never checks national registers, never emails anyone and never files anything with an authority.
Article 19(2): checks before making packaging available
Before making packaging available on the market, distributors must check that: (a) the producer subject to extended producer responsibility for the packaging is registered in the register of producers referred to in Article 44; (b) the packaging is labelled in accordance with Article 12; and (c) the manufacturer and importer have met their identification duties under the Regulation (Article 19(2) PPWR).
Product Registry does not query Article 44 registers. On each SKU, use the PPWR markets tab to record declared roles, per-country EPR facts, the own-brand as manufacturer flag and your internal distributor check note.
Article 19(6): documents on request, no 10-day rule for distributors
Distributors must provide documents on request under Article 19(6) PPWR. Unlike manufacturers (Article 15(10)), importers (Article 18(8)) and authorised representatives (Article 17(2)(d)), the regulation text does not set a 10-day period for distributors.
If you receive a reasoned request from a national authority, log it on the packaging authority requests board to track your own workflow. You submit files yourself; Product Registry prepares bundles only.
Article 21: own brand or modified packaging
An importer or distributor that places packaging on the market under its own name or trademark, or that modifies packaging, is considered a manufacturer for the purposes of PPWR and is subject to the obligations of the manufacturer under Article 15 (Article 21).
When that scenario applies, your team may need the technical documentation index, EU declaration of conformity and retention rules described in the PPWR declaration guide, not only distributor checks.
See the dedicated PPWR own-brand guide in the related guides list below for Article 21 duties and how Product Registry helps record roles and evidence.
Article 44(4): registration wording
Article 44(4) PPWR states: "Producers shall not make available packaging or packaged products on the territory of a Member State for the first time on the market of that Member State if they or, where applicable, in accordance with Article 45, their authorised representatives for the extended producer responsibility are not registered in that Member State."
Whether this already applies before new national PPWR registers are fully operational, and whether existing national EPR registers count, is to confirm with your adviser. Product Registry does not interpret national register law.
How Product Registry helps
Record declared roles and per-country EPR facts on the SKU PPWR markets tab, including the own-brand flag and the distributor check record. Use the org-wide EPR registration summary under Markets, the authority requests board, supplier evidence requests and the packaging technical readiness board to see gaps across units.
Product Registry does not verify register entries, does not email suppliers or authorities and does not certify conformity.
